full faith and credit (clause) 〈美〉充分信任和尊重(条款) 联邦制的一个严重后果就是总会存在各类辖区内法律相冲突的可能。美国宪法第四条中的联邦法律效力最高条款〔Supremacy Clause〕对州法与联邦法的冲突予以规范,而该条中的充分信任和尊重条款则调整的是州法之间的冲突。它要求每州对其他各州的公共法律〔public acts〕、案卷和司法程序应给予充分信任和尊重,承认其效力。不过这种充分信任是有条件的,即只能在他州的上述内容依照该州的法律合法成立并且有效时才可以,原来的州不承认的行为,不能要求他州承认,他州所承认的效力不能超过该行为所产生的州的法律所给予的效力。此外,该条款在适用时有例外,其中最主要的例外是一州只适用自己的刑事法律,不适用他州的刑事法律。充分信任和尊重条款旨在保持州与州之间的友好关系,当人们从一州到另一州时该条款即保护其法定权利,也促使法定义务的实现,随着美国人口流动的增加这显得尤其重要。
